Can You File For Divorce Even If Your Spouse Disagrees?
Yes, you can end your marriage even if your spouse does not want one. To file for divorce in California, the law does not require you to provide evidence of any marital misconduct by your spouse.
You only need to state that you have “irreconcilable differences,” which is the legal ground for a no-fault divorce, meaning the court finds the marriage is irretrievably broken due to substantial reasons.
What If You Don’t Know The Current Location Of Your Spouse?
A divorce can still move forward even if one spouse has moved out of California. If you cannot find them, you must demonstrate to the court that you have made a diligent search to locate them.
If you exhaust all reasonable efforts to find them, the court may permit an alternative method of notification, such as “service by publication,” which can include publishing a legal notice in a newspaper, to move the divorce forward.
How Long Does A Divorce Take In Los Angeles?
California law requires a minimum waiting period of six months and one day from the date you officially serve your spouse with the divorce papers or from the filing date of the appearance document, whichever occurs first.
The actual time the process takes depends on how quickly you and your spouse can agree on issues such as child custody, property division and alimony.
